Our Experience
Whiteside & Knowles have had a number of clients nationwide (including surviving spouses, cohabitees of more than two years and civil partners), who have successfully been awarded a “Fair Share” of the deceased’s estate. Ex-wives and of course ex-husbands are also entitled to contest the Will and bring a claim, so long as they have not remarried. Other members of the family who were dependant on the deceased, e.g. children, may claim a share of the estate if the Will does not provide them with one or the share is not sufficient.

Contesting a Will
The loss of a relative or someone you have relied upon both emotionally and financially can have a devastating effect on you. This difficult period can be further compounded if you feel that your loved one has not adequately provided for you in their Will or you have concerns as to the validity of the Will in general. There are several ways in which a Will can be contested:

  • The Will can be judged invalid due to concerns relating to matters such as Incapacity, Duress and Fraud and set aside altogether.
  • There can be a dispute over what is intended in the Will so that some, or all of the bequests made may fail.
  • Alternatively, as explained above, someone who was dependant on the deceased, prior their death, can make a claim to the court if they feel the Will does not adequately provide for them.
