Alternative Dispute Resolution
and Mediation

What is it?
Alternative Dispute Resolution involves different methods of resolving legal disputes without involving the courts.

Mediation is one method of dispute resolution.

Conflicts can nearly always be resolved where there is willingness, on both sides, to find a settlement that deals with concerns that have been fully clarified.

When can it be used?
The typical areas where you can use mediation in the resolution of a legal dispute are:
  • Family Matters
  • Commercial Disputes
  • Employment Disputes
  • Civil Disputes
  • Personal Injury
How does it work?
  • The process of mediation can be started by anyone involved in the dispute
  • It can be suggested by either party or their solicitors and may take place before that matter proceeds to court
  • It is a voluntary process and is often cheaper and quicker than going to court
  • Both sides to the dispute are involved and a Mediator will help them to reach a practical and constructive solution to their problem
  • The Mediator will not take sides or give guidance but will assist in the clarification of the issues arising in the dispute.
What are the benefits of Mediation?
Mediation can help both sides to:
  • Reduce tension and hostility
  • Make decisions on an informed basis
  • Tailor-make solutions to their particular requirements
  • Communicate and co-operate
  • Explore and examine options
  • Appreciate and consider the needs of the children
  • Express their feelings in a secure environment
  • Resolve financial matters
  • Save legal costs
