What is it?
The law of negligence covers a huge number of situations in which liability may arise. Where there is a legal duty of care towards you and an individual or organisation has breached that duty of care they may be held responsible for any injury or loss you sustained and have to pay damages as compensation.
Negligence actions include personal injury such as road traffic accidents, accidents occurring in the course of employment and public liability.
If you instruct us on your negligence claim then we will ensure active case management of your matter and pursue your claim as efficiently and cost effectively as possible.Medical Negligence (also called Clinical Negligence)
If you think that you have been injured due to the act or omission of a medical professional for example your surgeon, physiotherapist, or dentist you may have a claim for compensation for your injuries. Have you suffered from a misdiagnosis made by your doctor, or a surgical procedure which was carried out negligently? Our caring, specialist litigation team have the skills and expertise to advise you whatever medical negligence situation you are faced with. We will assess the strength of your claim and give you independent, professional advice.
Educational Negligence
Negligence claims can be brought against a School, Local Authority or Further and Higher Education establishment. Claims can be brought both in the state and private sectors. In a school setting there may be a case of educational negligence when a child with special educational needs has not received educational provision suitable for his needs, e.g. there was a failure to put in place a Statement of Special Educational Needs or the Statement was not reviewed and amended appropriately.A child has 3 years from reaching 18 years of age to bring a claim unless there are special circumstances or the facts on which the claim is based only become apparent at a later date, e.g. an expert report subsequently identifies that the claimant had a special educational need which had been undiagnosed whilst at school.
In the Further and Higher Education sector, for example at a College or University, a negligence claim may arise when there has been an alleged breach of the duty of care which the institution owes to its students. This could be because of failure to provide reasonable supervision for the student’s work or to keep the student safe from harm e.g. in a laboratory or on a field trip.Professional Negligence
All professional advisors have a duty of care to provide a certain standard of service to their clients. If your professional adviser falls below the minimum standard and you suffer financial loss you may have a claim. So if your surveyor advises you negligently regarding the value of a property you may be able to bring proceedings for professional negligence to recoup your loss.
Professional advisors who owe their clients a duty of care include solicitors, barristers, accountants, surveyors, architects, estate agents, and financial advisers.
